These Terms & Conditions ("Terms") form a legal agreement between you and ChallengeKit.

By using our website, landing pages, quiz, forms, calendar, software, community areas, emails, content, services, or by buying any plan, session, or offer from ChallengeKit, you agree to these Terms.

If you do not agree, do not use ChallengeKit.

1. Who We Are

ChallengeKit ("ChallengeKit," "we," "our," or "us") provides software, pages, tools, content, support, calls, and related services for creators, coaches, and businesses who want to set up and run challenges and related sales flows.

2. These Terms Apply To

These Terms apply to all use of ChallengeKit, including:

  • our website
  • our landing pages
  • our quiz and application pages
  • our calendar booking pages
  • our emails and messages
  • our software and dashboard
  • our coaching or strategy calls
  • our templates, downloads, videos, and training
  • our paid offers, plans, and subscriptions
  • our community features
  • any other page, tool, or service that links to these Terms

3. Eligibility

You must be at least 18 years old to use ChallengeKit.

By using ChallengeKit, you say that:

  • you are at least 18
  • you can legally agree to these Terms
  • you will use ChallengeKit for a real business or lawful personal use
  • the information you give us is true and up to date

If you are using ChallengeKit for a business, you say that you have the right to act for that business.

4. Changes to These Terms

We may update these Terms from time to time.

If we do, we will post the updated version and change the “Last Updated” date above.

If you keep using ChallengeKit after the updated Terms go live, that means you accept the new Terms.

If you do not agree with the updated Terms, stop using ChallengeKit.

5. Your Account

To use some parts of ChallengeKit, you may need to create an account.

You agree to:

  • give correct information
  • keep your login details private
  • keep your password safe
  • tell us if you think someone used your account without permission
  • accept responsibility for activity under your account unless the law says otherwise

We may suspend or close your account if we believe:

  • your information is false
  • your use breaks these Terms
  • your use puts us, other users, or the service at risk
  • your account is inactive for a long period and the law allows closure

You may not share accounts unless your plan clearly allows it.

6. Services We Provide

ChallengeKit may include one or more of the following:

  • challenge-building software
  • hosted pages and forms
  • community features
  • messaging or email features
  • templates
  • reporting or analytics
  • support services
  • training content
  • strategy sessions
  • founder-led sessions
  • call booking flows
  • paid subscriptions
  • limited-time offers
  • bonus material
  • AI-related features, where offered

Some services may be updated, changed, paused, or removed over time.

We do not promise that every feature will always be available.

7. No Promise of Business Results

ChallengeKit is a software and service business. We do not promise that you will make money, get clients, book calls, increase sales, or grow your business.

Any examples, screenshots, case studies, results, or testimonials are shared for example only.

They do not promise that you will get the same result.

Your results depend on many things, including:

  • your offer
  • your price
  • your market
  • your audience
  • your traffic
  • your follow-up
  • your sales process
  • your message
  • your effort
  • your timing

ChallengeKit is not a job offer, business opportunity, or get-rich program.

8. Founder-Led Sessions, Strategy Calls, and Other Calls

If you book a founder-led session, strategy call, or any other call with ChallengeKit:

  • you must provide true booking information
  • you must show up on time
  • you must join from a working device and internet connection
  • you must act respectfully
  • you may be asked to reschedule if you are late
  • we may cancel or reschedule a call if needed

We do not promise that a booked call will result in:

  • acceptance into an offer
  • a business plan that works for you
  • a sale
  • a result
  • access to future services

If a page or offer says there is an application step, we may choose who is invited to book or continue.

We may refuse, cancel, or close a booking if:

  • you do not meet the stated rules
  • you give false information
  • you are rude, abusive, or disruptive
  • you book in bad faith
  • you are outside the intended audience for the offer

9. Plans, Pricing, and Offers

ChallengeKit may offer free plans, paid plans, subscriptions, one-time purchases, founder sessions, or other pricing models.

Prices may change at any time.

If you are already on a paid subscription, price changes will usually apply from the next billing cycle unless we clearly say otherwise.

We may also offer:

  • limited-time deals
  • bonus access
  • plan upgrades
  • plan downgrades
  • custom pricing
  • team pricing
  • annual pricing
  • early-user pricing

All pricing, features, and limits will be shown on the relevant page or order form.

If there is a conflict between these Terms and a specific order form or offer page, the order form or offer page controls for that purchase.

10. Payments

You agree to pay all charges linked to your order, subscription, or plan.

Payments may be handled by third-party providers such as Stripe or others.

By buying from ChallengeKit, you agree that:

  • you are allowed to use the payment method
  • the payment details are correct
  • we may charge the amount shown at checkout
  • recurring subscriptions may renew automatically unless canceled in time

If your payment fails, we may:

  • retry the payment
  • limit access
  • suspend your account
  • cancel your plan
  • ask you to update your billing method

You are responsible for any taxes, duties, bank fees, or currency conversion fees unless the law says otherwise.

11. Subscription Billing and Renewal

If you buy a subscription:

  • it may renew automatically
  • you will be billed on the cycle shown at checkout
  • your access may continue until you cancel or the subscription ends
  • canceling stops future billing but does not usually create a refund for the current billing period unless your order form says otherwise

You must cancel before the next renewal date if you do not want the next charge.

If you cancel, you may keep access until the current paid term ends, unless we clearly say otherwise.

12. Refunds

Refund rights depend on the product, plan, or offer you bought.

Some offers may have:

  • no refund
  • a limited refund window
  • a conditional refund
  • a guarantee with specific rules
  • a custom written rule on the order page

If a refund or guarantee is offered on the sales page or order form, that rule applies to that purchase.

If no refund promise is shown, then all payments are final to the fullest extent allowed by law.

If your offer includes a conditional guarantee, you must meet all stated conditions before a refund is reviewed.

For example, if an offer says you must complete certain steps, submit certain proof, or use the service in a certain way, those conditions must be met.

We may refuse refund requests where:

  • the refund window has passed
  • the guarantee terms were not met
  • the request is dishonest
  • there is abuse of the offer
  • chargeback abuse or fraud is involved

13. Chargebacks and Payment Disputes

Before starting a chargeback or payment dispute, you agree to contact us first and give us a fair chance to review the issue.

If you start a chargeback without a valid reason, we may:

  • suspend your account
  • cancel access
  • refuse future service
  • recover unpaid amounts
  • submit records to fight the dispute

This section does not remove any rights you have under the law.

14. Your Content

You may upload, post, submit, write, or send content through ChallengeKit, including:

  • text
  • emails
  • graphics
  • pages
  • comments
  • community posts
  • videos
  • forms
  • files
  • participant data
  • prompts
  • challenge material

You keep ownership of the content you create, except where third-party content is involved.

But by uploading or using content in ChallengeKit, you give us a limited license to:

  • host it
  • store it
  • copy it
  • process it
  • display it
  • send it
  • back it up
  • format it
  • improve service delivery
  • use it as needed to operate the service

This license exists only so we can provide the service.

You say that you have the rights needed to use and upload your content.

You also say your content does not break the law or anyone else’s rights.

15. Content Rules

You may not use ChallengeKit to upload, send, or publish content that:

  • is illegal
  • is fraudulent
  • is hateful or abusive
  • is violent or threatening
  • is sexually explicit in a way that breaks platform rules or law
  • breaks copyright, trademark, privacy, or other rights
  • includes viruses, harmful code, or malicious links
  • is spam
  • is deceptive
  • impersonates a person or business
  • promotes scams
  • breaks these Terms or any related policy

We may remove content or suspend access if we believe content breaks these rules.

16. Acceptable Use

You agree not to:

  • misuse the service
  • copy or scrape the service without permission
  • reverse engineer the service unless the law clearly allows it
  • test the service for weakness without permission
  • interfere with site or app performance
  • send spam through the system
  • use the service to break the law
  • bypass plan limits, usage limits, or account controls
  • resell access unless your plan or a written contract allows it
  • use the service in a way that hurts other users or our business

We may investigate misuse and take action, including suspension, account closure, legal action, or reporting to authorities.

17. Intellectual Property

ChallengeKit owns or has permission to use all rights in:

  • our brand name
  • our logo
  • our software
  • our pages
  • our designs
  • our code
  • our copy
  • our videos
  • our templates
  • our training
  • our dashboards
  • our documents
  • our graphics
  • our systems
  • our methods, to the extent allowed by law

Your use of ChallengeKit does not give you ownership of any ChallengeKit intellectual property.

You may not copy, resell, reuse, republish, or create competing products from our material unless we clearly give written permission.

This section does not stop you from using what you create inside your own account, subject to these Terms and any specific plan limits.

18. Feedback

If you send us ideas, feedback, feature requests, or suggestions, we may use them without restriction and without paying you.

This includes ideas about:

  • features
  • design
  • pricing
  • workflows
  • fixes
  • marketing
  • product direction

19. AI Features and Generated Output

If ChallengeKit offers AI features, those features may produce output based on prompts, content, or files you provide.

AI output may be wrong, incomplete, or unsuitable for your use.

You are responsible for reviewing, editing, and approving anything generated before using it.

We do not promise that AI output will be:

  • correct
  • unique
  • lawful
  • fit for your use
  • free from third-party claims

Do not rely on AI output alone for legal, tax, health, or other high-risk decisions.

20. Third-Party Services and Integrations

ChallengeKit may connect with third-party services such as payment tools, email tools, ad tools, calendar tools, video tools, AI tools, analytics tools, and others.

We are not responsible for third-party services.

Your use of those services may also be subject to their own terms and policies.

If a third-party service changes, fails, raises prices, removes access, or stops working, we are not responsible for that.

21. Availability of Service

We aim to keep ChallengeKit running, but we do not promise that the service will always be:

  • available
  • uninterrupted
  • error-free
  • secure
  • free from delay

We may suspend, limit, or stop part of the service for:

  • updates
  • maintenance
  • security issues
  • legal reasons
  • provider issues
  • product changes

We are not responsible for losses caused by downtime or interruptions unless the law says otherwise.

22. Beta Features

We may offer beta, test, early, trial, or preview features.

These may change or stop at any time.

They may have bugs or limits.

We may remove them without notice.

Use them at your own risk.

23. Community and Conduct

If ChallengeKit includes any group, chat, community, comments, or member area, you agree to act respectfully.

You may not:

  • bully or harass others
  • post spam
  • mislead others
  • steal data
  • share private information without permission
  • post harmful or unlawful material

We may remove posts, mute users, suspend access, or close accounts where needed.

24. Confidentiality

If you receive private information from us during a call, demo, training, or service use, you agree not to share it without permission.

Likewise, if you share confidential information with us, we will use reasonable care, but we cannot promise absolute secrecy unless there is a separate written confidentiality agreement.

Please do not send highly sensitive or secret information unless necessary.

25. Testimonials, Reviews, and Public Comments

If you send us a testimonial, review, comment, screenshot, win, or success story, we may ask to use it in marketing.

If you agree, we may use your name, brand name, photo, quote, result, logo, screenshot, or other approved material.

If you do not want your testimonial used, tell us clearly in writing.

If we agree to anonymize a story, we will try to remove identifying details, but full anonymity cannot always be promised in every case.

26. Data and Privacy

Your use of ChallengeKit is also subject to our Privacy Policy and Cookie Policy.

Please read them carefully.

If you use ChallengeKit to collect data from your own leads, clients, or participants, you are responsible for following your own privacy duties and legal duties.

27. No Professional Advice

ChallengeKit does not provide legal, tax, accounting, health, or financial advice.

Any content, templates, examples, or calls are for general business and software use.

You should talk to a qualified professional before making legal, tax, health, or major business decisions.

28. Disclaimer of Warranties

To the fullest extent allowed by law, ChallengeKit is provided “as is” and “as available.”

We do not make promises or warranties that:

  • the service will meet all your needs
  • the service will be uninterrupted
  • the service will always be accurate
  • the service will always be available
  • the service will be error-free
  • the service will lead to business success
  • any user will get any result

This includes express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent allowed by law.

29. Limitation of Liability

To the fullest extent allowed by law, ChallengeKit and its owners, team, contractors, partners, and suppliers will not be liable for indirect, special, incidental, consequential, or punitive damages.

This includes loss of:

  • revenue
  • profit
  • goodwill
  • data
  • business opportunity
  • clients
  • use of service

If the law allows liability limits, our total liability for any claim related to ChallengeKit will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing, whichever is greater.

Some places do not allow certain limits, so part of this section may not apply to you.

30. Indemnity

You agree to defend, indemnify, and hold harmless ChallengeKit and its owners, team, contractors, and partners from claims, losses, damages, liabilities, costs, and expenses, including legal fees, that arise from:

  • your use of the service
  • your content
  • your violation of these Terms
  • your violation of another person’s rights
  • your unlawful acts
  • your misuse of data collected through the service

31. Termination

You may stop using ChallengeKit at any time.

We may suspend or terminate your access at any time if:

  • you break these Terms
  • you misuse the service
  • your payment fails
  • you create risk for us or others
  • we must do so for legal or security reasons

After termination:

  • your right to use the service ends
  • we may close your account
  • we may delete or limit access to your data according to our retention rules
  • some sections of these Terms will still apply, including payment, intellectual property, disclaimers, liability, disputes, and indemnity

32. Export, Sanctions, and Restricted Use

You may not use ChallengeKit if doing so would break export, sanctions, or trade rules that apply to you or to us.

You may not use ChallengeKit for any restricted or unlawful use.

33. Governing Law

These Terms are governed by the laws of [Insert Country/State], without regard to conflict-of-law rules.

34. Dispute Resolution

If the issue is not resolved within [30] days, either side may pursue the claim as allowed by law.

If you want an arbitration clause instead of court language, add that after lawyer review.

35. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, such as:

  • internet failures
  • hosting failures
  • power outages
  • labor disputes
  • natural disasters
  • public health events
  • war
  • civil unrest
  • government orders
  • third-party platform outages

36. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, refund terms on the order page, and any signed order form or custom agreement, form the full agreement between you and ChallengeKit about your use of the service.

They replace earlier discussions or understandings about the same subject.

37. Severability

If one part of these Terms is found invalid or unenforceable, the rest of the Terms will still apply.

38. No Waiver

If we do not enforce one part of these Terms right away, that does not mean we give up our right to enforce it later.

39. Assignment

You may not transfer your rights or duties under these Terms without our written permission.

We may transfer our rights or duties to an affiliate, buyer, successor, or part of a business transfer.
